Real Estate Disposition: Closure of an unimproved 15-foot wide alley Public Right-of-Way

 

 

SUMMARY:

 

A Resolution recommending the closure, vacation and abandonment of an unimproved 15-foot wide alley Public Right-of-Way in City Council District 7, as requested by Archbishop Gustavo Garcia-Siller and His Successors in Office, for a fee of $9,633.00.

 

BACKGROUND INFORMATION:

 

Archbishop Gustavo Garcia-Siller and His Successors in Office (Petitioner) is requesting to close, vacate and abandon an unimproved 15-foot wide alley Public Right-of-Way located between Callaghan Road and Horizon Drive within New City Blocks 12283 and 14277 in Council District No. 7, as shown on the attached map.  St. Luke Catholic Church operates on Petitioner’s property at 4603 Manitou Drive. If approved, Petitioner will use the area for the storage of portable equipment for church functions. St. Luke Catholic Church Men’s Club has portable grills they use for their Wild Game Dinner and other events conducted at the parish. St. Luke Catholic Church spends $6,000.00 a year on a public storage facility. Petitioner has indicated it can use the funds spent on the storage fee to help those in need. All the abutting property owners have consented to the proposed closure. RE Office - TX II LLC, the other abutting owner, has written a letter to relinquish its rights to purchase half of the alley.

 

 

ISSUE:

 

This Resolution authorizes the closure, vacation and abandonment of an unimproved 15-foot wide alley Public Right-of-Way in City Council District 7, as requested by Archbishop Gustavo Garcia-Siller and His Successors in Office, for a fee of $9,633.00.

 

Archbishop Gustavo Garcia-Siller and His Successors in Office (Petitioner) is requesting to close, vacate and abandon an unimproved 15-foot wide alley Public Right-of-Way located between Callaghan Road and Horizon Drive within New City Blocks 12283 and 14277 in Council District No. 7, as shown on the attached map. The public right-of-way closure consists of 0.073 of an acre (3,199 square feet).  If approved, Petitioner will use the area for the storage of portable equipment for church functions. St. Luke Catholic Church Men’s Club has portable grills they use for their Wild Game Dinner and other events conducted at the parish. St. Luke Catholic Church spends $6,000.00 a year on a public storage facility. Petitioner has indicated it can use the funds spent on the storage fee to help those in need. All the abutting property owners have consented to the proposed closure. RE Office - TX II LLC, the other abutting owner, has written a letter to relinquish its rights to purchase half of the alley.

 

This action is consistent with City Code and Ordinances, which requires City Council approval for the sale or disposition of City-owned or controlled real property.

 

ALTERNATIVES:

 

Planning Commission could choose not to approve this request; however, Petitioner will not be allowed to use the proposed closure with its adjacent property for the storage of portable equipment for church functions.

 

 

FISCAL IMPACT:

 

The fee established for this request is $9,633.00, which includes the assessed value of the public right-of-way in the amount of $9,533.00 plus $100.00 for administrative costs. In compliance with Chapter 37 of the City Code, Section 37-2, fair market value of the unimproved public right-of-way was based utilizing Bexar Appraisal District assessed land values as provided by Chapter 37, Section 2(g)(2) of the City Code. These funds will be deposited into the General Fund in accordance with the FY 2020 Adopted Budget.

 

The property will be placed on the tax rolls, which will generate revenue for the City of San Antonio as well as other taxing entities.

 

RECOMMENDATION:

 

Staff recommends approval of this request to close, vacate and abandon an unimproved 15-foot wide alley Public Right-of-Way in City Council District 7.
