Design-Build Contract Amendment: Prue Road (Babcock Road to Laureate Drive) (2017 Bond Project)
SUMMARY:
Consideration of the following items related to the Prue Road (Babcock Road to Laureate Drive) project, a 2017 Bond funded project, located in Council District 8:
A. An ordinance approving the execution of an amendment in the increased amount not to exceed $600,000.00 to the $31,700,000.00 Design-Build Contract between the City of San Antonio and J.D. Abrams, L.P. for design and construction services for additional joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project located in Council District 8. Of this amendment amount, $600,000.00 will be reimbursed by Grey Forest Utilities. Funding is available from 2017 General Obligation Bond Program and is included in the FY 2020 - FY 2025 Capital Improvement Program.
B. An ordinance approving the acceptance of funds from Grey Forest Utilities in the amount not to exceed $600,000.00; and authorizing the appropriation and amending of the FY 2020 - FY 2025 Capital Improvements Program Budget with these funds for joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project, a 2017 Bond funded project located in Council District 8.
BACKGROUND INFORMATION:
Project Background
On May 6, 2017, San Antonio voters approved the 2017 Bond Program consisting of six propositions totaling $850 Million to be used on various capital improvement projects to address community infrastructure needs and improve the overall quality of life in San Antonio. As part of Proposition 1 Streets, Bridges & Sidewalk Improvements, funds in the amount of $27,600,000.00 were approved for improvements associated with the Prue Road (Babcock Road to Laureate Drive) project.
The Prue Road (Babcock Road to Laureate Drive) project will provide for the reconstruction and widening of Prue Road from Babcock Road to Laureate Drive with curbs, sidewalks, a shared-use path, traffic signals, and drainage improvements including joint utility relocation and adjustments. Project construction is anticipated to begin in June 2020 and is estimated to be completed by March 2023.
Previous Council Action
On April 18, 2019, City Council approved a Design-Build contract with J. D. Abram, L.P. in the amount of $31,700,000.00 through Ordinance 2018-04-19-0284. There have been no previous amendments to this contract. The proposed amendment for additional design and construction services will increase the contract by $600,000.00 to a total contract amount of $32,300,000.00.

ISSUE:
Consideration of the following items related to the Prue Road (Babcock Road to Laureate Drive), a 2017 Bond funded project, located in Council District 8:
A. This ordinance approves the execution of an amendment in the increased amount not to exceed $600,000.00 to the $31,700,000.00 Design-Build Contract between the City of San Antonio and J.D. Abrams, L.P. for design and construction services for additional joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project located in Council District 8. Of this amendment amount, $600,000.00 will be reimbursed by Grey Forest Utilities. Funding is available from 2017 General Obligation Bond Program and is included in the FY 2020 - FY 2025 Capital Improvement Program.
As part of the Design-Build contract, joint-bid utility work was included as part of the Prue Road (Babcock Road to Laureate Drive) project scope. Prior to start of the project, CPS Energy and SAWS had committed to joint-bidding with the City given the foreseeable adjustments and relocation of their respective utilities associated with the project. After design was underway, it was identified that Grey Forest Utilities would require utility work in conjunction with the project. In an effort to keep project on track and to expedite the completion of the associated utility work, Grey Forest Utilities has agreed to joint-bid with City.
This amendment will be compensating J.D. Abrams, L.P. for the design and construction phase services needed to complete additional Grey Forest Utilities joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project. Upon approval of this amendment, project construction is anticipated to begin in June 2020 and is estimated to be completed by March 2023.
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2017-2022 General Obligation Bond funded projects.
B. This ordinance approves the acceptance of funds from Grey Forest Utilities in the amount not to exceed $600,000.00 and authorizes the appropriation and amending of the FY 2020 - FY 2025 Capital Improvements Program Budget with these funds for joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project located in Council District 8.
The acceptance of the funds from Grey Forest Utilities is necessary to ensure full funding of the added joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) project. Grey Forest will reimburse the City for all costs associated with the design and construction of their utility facilities.
Approval of this ordinance will be a continuation of City Council policy to collaborate with other governmental agencies in supporting the City’s commitment to maintaining and improving existing infrastructure.
ALTERNATIVES:
A. As an alternative, City Council could choose not to approve this contract amendment and require Grey Forest Utilities to advertise the associated utility work related this Project. However, considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.
B. City Council could choose not to accept the funds from Grey Forest Utilities; however, without the acceptance of these funds, the City will lose the opportunity to collaborate with Grey Forest Utilities which will require Grey Forest Utilities to construct their utility work before the City can begin construction of the Project. This will delay the timely completion of the Project resulting in an extended inconvenience to the public.
FISCAL IMPACT:
A. This is a one-time capital improvement expenditure in the amount not to exceed $600,000.00, authorized payable to J.D. Abrams, L.P. Of this amendment amount, $600,000.00 will be reimbursed by Grey Forest Utilities. Funds in the amount of $600,000.00 are available from 2017 General Obligation Bond Program and are included in the FY 2020 - FY 2025 Capital Improvement Program Budget.
B. This ordinance approves the acceptance of reimbursable funds in the amount of $600,000.00 from Grey Forest Utilities for joint-bid utility work associated with the Prue Road (Babcock Road to Laureate Drive) Project. This ordinance also approves the appropriation and amending of the FY 2020 - FY 2025 Capital Improvements Program with these funds for the Prue Road (Babcock Road to Laureate Drive) project.
RECOMMENDATION:
Staff recommends the approval the following items related to Prue Road (Babcock Road to Laureate Drive) project:
