Contract Award: Judson Road Sidewalks (IH 35 to Independence Avenue) Project
SUMMARY:
An ordinance accepting the lowest responsive bid and awarding a construction contract to Lone Star Sitework, LLC in the amount of $1,116,513.22 of which $968,000.00 will be funded by the Texas Department of Transportation (TxDOT) and $19,825.00 will be reimbursed by San Antonio Water System (SAWS) for construction of the Judson Road Sidewalks (IH 35 to Independence Avenue) project, a previously authorized debt funded project, located in Council District 10. Funds are available from previously authorized debt proceeds and included in the FY 2020 - FY 2025 Capital Improvement Program.
BACKGROUND INFORMATION:
Project Background
As part of the City’s commitment to maintaining and improving existing infrastructure, the City will construct sidewalks on Judson Road from Independence Avenue to Interstate 35 leveraging funding from TxDOT. The Judson Road Sidewalks project will provide for sidewalks, curbs, accessibility ramps and the mill and overlay of pavement along the west side of Judson Road. Project construction is anticipated to begin in July 2020 and estimated to be completed by March 2021.
This project was selected for funding through the Alamo Area Metropolitan Planning Organization (AAMPO) Transportation Improvement Program (TIP). Local Agency Managed projects are managed by the City but receive federal funds administered through TxDOT. The funds paid to TxDOT by the City are for costs associated with oversight for administration of the federal funds.
Previous Council Action
An Advanced Funding Agreement between TxDOT and the City of San Antonio accepting reimbursement in the estimated amount not to exceed $968,000.00 from TxDOT for construction-related expenses and authorizing payment in the amount not to exceed $12,166.00 to TxDOT for administrative oversight of federal funds for the Judson Road Sidewalks Project was approved by City Council on January 31, 2019 through Ordinance 2019-01-31-0100. Upon approval of the Advanced Funding Agreement, TxDOT requested language revisions to the Agreement before the final execution of the agreement. A revised Advanced Funding Agreement between the City of San Antonio and TxDOT was approved by City Council on August 22, 2019 through Ordinance 2019-08-22-0653. The required revisions did not impact the scope of work or funding for the Project.
Procurement of Services
This project was advertised on February 7, 2020 for construction bids in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily, on TVSA, through electronic bidding site CivCast and through the TCI Small Business Office. Bids were opened on March 17, 2020 and two bids were received. Of these, Lone Star Sitework, LLC submitted the lowest responsive bid. A matrix of the bid outcome is included herein.
Due to the utilization of federal funding, the Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of the Small Business Economic Development Advocacy (SBEDA) Program. The DBE goal for this project is 9.0%.
This construction contract was developed utilizing the low bid process; therefore, a Contracts Disclosure Form is not required.
ISSUE:

ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise the project; however, considering the additional time required for another solicitation process this would adversely affect the timely completion of the project.
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $1,116,513.22 payable to Lone Star Sitework, LLC. Of this amount, $968,000.00 will be funded by TxDOT and $19,825.00 will be reimbursed by SAWS. Funds are available from previously authorized debt proceeds and included in the FY 2020 - FY 2025 Capital Improvement Program.
RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract to Lone Star Sitework, LLC in the amount of $1,116,513.22, of which $968,000.00 will be funded by the Texas Department of Transportation (TxDOT) and $19,825.00 will be reimbursed by SAWS for the Judson Road Sidewalk (IH 35 to Independence Avenue) project.
