Interlocal Agreement & Contract Award: North Flores Street and Fredericksburg Road Intersection (Five Points) (2017 Bond Project)
SUMMARY:
Consideration of the following items related to North Flores Street and Fredericksburg Road Intersection (Five Points) project, a 2017 Bond funded project, located in Council District 1:
A. An ordinance approving an Interlocal Agreement with VIA Metropolitan Transit to establish terms and conditions of the acceptance of $500,000.00 for its share of construction-related expenses related to the North Flores Street and Fredericksburg Road Intersection (Five Points) project.
B. An ordinance accepting the lowest responsive bid and awarding a construction contract to E-Z Bel Construction, LLC in the amount of $2,332,637.79 of which $21,000.00 will be reimbursed by San Antonio Water System (SAWS) for the North Flores Street and Fredericksburg Road Intersection (Five Points) project. Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in FY 2020 - FY 2025 Capital Improvement Program.
BACKGROUND INFORMATION:
Project Background
On May 6, 2017, voters approved the 2017 Bond Program, which authorized $3,000,000.00 to reconstruct the North Flores Street and Fredericksburg Road (Five Points) intersection. The project will provide for the reconstruction of the North Flores Street and Fredericksburg Road intersection including new sidewalks, bike lanes, traffic signal upgrades and public transportation amenities. Once completed, the project will improve traffic flow and functionality of the roadway for businesses and the public. Project construction is anticipated to begin in June 2020 and is estimated to be completed by May 2021.
In partnership with the City, the VIA Metropolitan Transit has agreed to fund $500,000.00 for the construction of transit supportive improvements related to the North Flores Street and Fredericksburg Road (Five Points) intersection project.
Procurement of Services
This project was advertised on January 17, 2020 for construction bids in the San Antonio Hart Beat, on the City’s website, the Texas Electronic State Business Daily, on TVSA, through the electronic bidding website CIVCAST, and through the Public Works Small Business Office. Bids were opened on March 10, 2020 and three (3) bids were received. Of these, E-Z Bel Construction LLC, submitted the lowest responsive bid.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts to be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority and women-owned business participation on the contract. The Goal Setting Committee set a 28% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 2% African American Business Enterprise (AABE) subcontracting goal. E-Z Bel Construction, LLC has committed to meeting the subcontractor participation goal.
This construction contract was developed utilizing the low bid process. Therefore, a Contracts Disclosure Form is not required.
ISSUE:
Consideration of the following items related to North Flores Street/Fredericksburg Road Intersection (Five Points) project, a 2017 Bond funded project, located in Council District 1:
A. This ordinance approves an Interlocal Agreement with VIA Metropolitan Transit to establish terms and conditions of the acceptance of $500,000.00 for its share of construction-related expenses related to the North Flores Street and Fredericksburg Road Intersection (Five Points) project.
In partnership with the City, the VIA Metropolitan Transit has agreed to fund $500,000.00 for the construction of transit supportive improvements related to the North Flores Street and Fredericksburg Road (Five Points) intersection project. The project will provide for the reconstruction and reconfiguration of the intersection to accommodate improved flow of transit traffic through the intersection and make available additional passenger amenities, including bus stop, seating, lighting and shelters. Funding will also provide for improved pedestrian and bicycle mobility; and, traffic signal upgrades.
B. This ordinance accepts the lowest responsive bid and awards a construction contract to E-Z Bel Construction, LLC in the amount of $2,332,637.79 of which $21,000.00 will be reimbursed by SAWS for the North Flores Street and Fredericksburg Road Intersection (Five Points) project.
The project will provide for the reconstruction and reconfiguration of the Five Points intersection on Fredericksburg Road from North Flores and North Laredo to La Harpe to improve pedestrian, bicycle and transit movement and allow VIA to provide additional transit facilities on the south side of the intersection. The project will include the reconstruction of the road, new sidewalks, bike lanes, traffic signal upgrades and public transportation amenities. Once completed, the project will improve traffic flow and functionality of the roadway for businesses and the public. Project construction is anticipated to begin in June 2020 and is estimated to be completed by May 2021.
ALTERNATIVES:
A. City Council could choose not to approve the Interlocal Agreement; however, without approval of the agreement, the City cannot complete the project. The project’s scope will have to be reduced and re-advertised. Considering the additional time required to re-advertise the project, this would adversely affect the timely completion of the project.
B. As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project. Considering the additional time required for another solicitation process, a re-advertisement would adversely affect the timely completion of the project.
FISCAL IMPACT:
A. This ordinance authorizes acceptance of funds in the amount of $500,000.00 from VIA Metropolitan Transit for construction related expenses related to North Flores Street and Fredericksburg Road Intersection (Five Points) project. The FY 2020 - FY 2025 Capital Improvement Program Budget will be amended to reflect the addition of these funds for this project.
B. This is a one-time capital improvement expenditure in the amount $2,332,637.79 of which $21,000.00 will be reimbursed by SAWS for the North Flores Street and Fredericksburg Road Intersection (Five Points) project. Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in the FY 2020 - FY 2025 Capital Improvement Program.
RECOMMENDATION:
Staff recommends approval of the following items related to the North Flores Street and Fredericksburg Road Intersection (Five Points) project:
