SUBJECT:

Extension of Line of Duty Leave

SUMMARY:

This Ordinance would extend the line-of-duty (LOD) leave for Fire Engineer Ronald Carrillo. He was charged accrued leave from December 14, 2019 until February 19, 2020 for an injury suffered while on duty on October 8, 2018. This ordinance will restore four hundred and eight (408) hours, or seventeen (17) shifts of accrued leave. Approval of this ordinance is only within the authority of City Council. The Local Government Code, Chapter 143.073, states that after the one-year initial period of leave, the municipality's governing body may extend the line of duty illness or injury leave at full or reduced pay. This will allow the Department to consider this period line of duty leave.


BACKGROUND INFORMATION:

Fire Engineer Carrillo was connecting an exhaust hose to an ambulance when the top of the hose disconnected from the fitting and fell approximately 15 feet, striking him on the head and back of the neck while on duty on October 8, 2018. He was diagnosed with a contusion to the back of his head, neck and right shoulder sprains, as well as, a concussion. On Line of Duty leave from October 9, 2018 until March 7, 2019, March 22, 2019 until April 17, 2019 and from June 10, 2019 until December 13, 2019. He began using additional accrued leave on December 14, 2019 until February 19, 2020. Fire Engineer Carrillo was released to light duty on February 20, 2019.


ISSUE:

Fire Engineer Ronald Carrillo seeks an extension of Line of Duty leave from December 14, 2019 until February 19, 2020 for an on the job injury suffered on October 8, 2018. This extension will restore 408 hours, or 17 shifts, of his accrued leave. Chapter 143 gives the City Council the authority to grant the extension of line-of-duty leave.
