SUBJECT:

Settlement of litigation styled Blanca Idalia Degollado and Priscilla Degollado v. City of San Antonio

SUMMARY:

This item will approve the settlement of a lawsuit styled Blanca Idalia Degollado and Priscilla Degollado v. City of San Antonio, Cause Number 2019-CI-04653, pending in the Bexar County 57th Judicial District Court in an amount of $275,000.00 payable from the Self-Insurance Liability Fund.



BACKGROUND INFORMATION:

On April 5, 2018, an auto accident occurred at SW Military Dr. and Pleasanton Rd[DB(A1]. in San Antonio, Texas involving a vehicle occupied by Blanca Idalia Degollado and Priscilla Degollado and a City owned vehicle being operated by an employee of the City's Solid Waste Management Department. Both Blanca Degollado and Priscilla Degollado suffered injuries, incurred medical expenses and are seeking to recover damages.

The parties have agreed to settle the claims of Blanca Degollado for $200,000.00 and the claims of Priscilla Degollado for $75,000.00, subject to City Council approval. The funds are available from the Self-Insurance Liability Fund.


ISSUE:

Settlements over $50,000 require City Council approval.


ALTERNATIVES:

If this settlement is not approved by the City Council, this case will proceed to a jury trial. It is in the best interest of the City to settle this matter to avoid the uncertainties and risks associated with litigation.


FISCAL IMPACT:

If approved, $200,000 will be paid to Blanca Degollado and $75,000 will be paid to Priscilla Degollado and their attorney of record Thomas J. Henry. This will be funded in accordance with the FY 2020 Liability Fund Adopted Budget.


RECOMMENDATION:

Staff recommends approval of this item.
