Amendment & Contract Award:  Mission Road (San Antonio River to Southeast Military Drive) (2017 Bond Project)

 

 

SUMMARY:

 

Consideration of the following items related to the Mission Road (San Antonio River to Southeast Military Drive) project located in Council District 3:

 

A.                     An ordinance approving the execution of an amendment in the increased amount of $202,954.03 to the $333,288.00 Civil Engineering Design Services Agreement between the City and GarzaEMC, LLC relating to the 2017 Bond Mission Road (San Antonio River to Southeast Military Drive) project located in Council District 3. Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in the FY 2021 - FY 2026 Capital Improvement Program.

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract including an additive alternate in the total amount of $3,973,933.97 to J. Sanchez Contracting, Inc., of which $60,595.68 will be reimbursed by the San Antonio Water System for the 2017 Bond Mission Road (San Antonio River to Southeast Military Drive) project located in Council District 3; and, authorizing the appropriation and amending of the FY 2021- FY 2026 Capital Improvements Program Budget with funds in the reimbursable amount of $1,131,305.00 from Mission Dive-In City TIRZ fund and $300,000.00 from the Airport Operating and Maintenance Fund for public improvements to the Mission Road (Southeast Military Drive to the San Antonio River) project.

 

 

BACKGROUND INFORMATION:

 

Project Background

On May 6, 2017, voters approved the 2017 Bond Program which authorized $2,000,000.00 for the Mission Road (San Antonio River to Southeast Military Dive) project located in Council District 3.  This project will consist of the construction and installation of brick pavers, continuous candy cane lighting assemblies, and associated electrical underground infrastructure including joint-bid utility sewer and water improvements along Mission Road from Southeast Military Drive to the San Antonio River along Acequia Road from Mission Road to Ashley Road.  The additive alternate work included as part of this contract will construct a shared-use-path along the east side of Mission Road from Southeast Military Drive to Stinson Airport including sidewalks along Mission Road from Cadmus to the San Antonio River and along Acequia Road from Mission Road to Ashley Road including any associated joint-bid utility sewer and water improvements. Project construction is anticipated to begin in January 2021 and is estimated to be completed by January 2022.

 

Amendment

On October 5, 2017, City Council approved a Civil Engineering Design Services Agreement with GarzaEMC, LLC in an amount not to exceed $333,288.00 for the design and construction phase services of the Mission Road (San Antonio River to Southeast Military Drive) project through Ordinance 2017-10-05-0742. The proposed amendment for additional design services will increase the contract by $202,954.03 to a total contract amount of $536,242.03.

In late 2018, the City’s World Heritage Office and the Public Works Department initiated the public input process for the Mission Road (San Antonio River to Southeast Military Drive) project.  As a result of the input provided, the Mission Road (San Antonio River to Southeast Military Dive) project will be designed to include the construction of a shared-use-path along the east side of Mission Road from Southeast Military Drive to Stinson Airport including sidewalks along Mission Road from Cadmus to the San Antonio River and along the west side of Acequia Road from Mission Road to Ashley Road.

 

On August 22, 2019, City Council approved through Ordinance 2019-08-22-0646 a Funding Agreement between the Board of Directors of the Mission Dive-In City TIRZ and City's World Heritage Office in the reimbursable amount not to exceed $1,131,305.00 for public improvements and eligible project costs for the Mission Road (Southeast Military Drive to the San Antonio River).  Given the additional funding, at the City’s discretion, design changes were requested to include the construction of a shared-use-path along the east side of Mission Road from Southeast Military Drive to Stinson Airport including sidewalks along Mission Road from Cadmus to the San Antonio River and along the west side of Acequia Road from Mission Road to Ashley Road.

 

This amendment will authorize the additional design services requested and rendered as of July 2020 and compensate GarzaEMC, LLC for additional engineering design, bid, construction phase and close-out phase services for the requested project design changes. 

 

Procurement of Services

This project was advertised on August 12, 2020, for construction bids in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily, on TVSA, and through the electronic bidding site CivCast.  Bids were opened on September 8, 2020, and two (2) bids were received.  Of these, J. Sanchez Contracting, Inc. submitted the lowest responsive bid. A matrix of the bid outcome is included herein.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 19% Minority/Women Business Enterprise (M/WBE) and a 2% African-American Owned Business Enterprise (AABE) subcontracting goal.  J. Sanchez Contracting, Inc. has agreed to meet the subcontracting participation goals.

 

This construction contract was developed utilizing the low bid process.  Therefore, a Contracts Disclosure Form is not required.

 

 

ISSUE:

Given the additional funding and based on the community input received, the City requested design changes to include the construction of a shared-use-path along the east side of Mission Road from Southeast Military Drive to Stinson Airport including sidewalks along Mission Road from Cadmus to the San Antonio River and along the west side of Acequia Road from Mission Road to Ashley Road.

 

This amendment will authorize the additional design services requested and rendered as of July 2020 and compensate GarzaEMC, LLC for additional engineering design, bid, construction phase and close-out phase services for the requested project changes. 

 

Upon completion of the project, the newly constructed sidewalks and multi-use path will provide safe connectivity for residents and visitors to cultural assets and amenities, such as the Stinson Municipal Airport, Stinson Hike & Bike Trail, San Antonio River Mission Reach/Riverwalk Trail, and Mission San Juan.

 

B.                     This ordinance accepts the lowest responsive bid and awards a construction contract including an additive alternate in the total amount of $3,973,933.97 to J. This project and the construction of these improvements will improve pedestrian safety and connectivity as well as provide continuous wayfinding and design continuity within the World Heritage Area. 

 

 

ALTERNATIVES:

 

A.                     As an alternative, City Council could recommend staff to move forward with the original design for the Mission Road (San Antonio River to Southeast Military Drive) project.  However, doing so would result in the loss of an opportunity to implement the community’s design input and staff’s inability to leverage Mission Drive-In City TIRZ funds.

 

B.                     As an alternative, City Council could require staff to re-advertise this project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project.

 

 

FISCAL IMPACT:

 

A.                     This is a one-time capital improvement expenditure in the increased amount of $202,954.03 authorized payable to GarzaEMC, LLC for additional design services for the Mission Road (San Antonio River to Southeast Military Drive ) project.  Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in the FY 2021 - FY 2026 Capital Improvements Program. 

 

B.                     This is a one-time capital improvement expenditure in the amount of $3,973,933.97 to J. Sanchez Contracting, Inc. of which $60,595.68 will be reimbursed by the San Antonio Water System.  Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in the FY 2021 - FY 2026 Capital Improvement Program. RECOMMENDATION:

 

A.                     Staff recommends approval of this ordinance amending the Design Services Agreement between the City and GarzaEMC, LLC in the increased amount of $202,954.03 for additional design services related to the Mission Road (San Antonio River to Southeast Military Drive) project.

 

B.                     Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract including an additive alternate in the amount of $3,973,933.97 to J. Sanchez Contracting, Inc., of which $60,595.68 will be reimbursed by the San Antonio Water System for Mission Road (San Antonio River to Southeast Military Drive) project.
