Contract Award: FY 2021 Neighborhood Access and Mobility Program and Infrastructure Management Program (Packages 1-3)

 

 

SUMMARY:

 

Consideration of the following four construction contracts totaling $6,151,065.92 to complete sidewalk repairs associated with the Neighborhood Access and Mobility Program (NAMP) and Infrastructure Management Program (IMP):

 

A.                     An ordinance accepting the lowest responsive bid and awarding the FY 2021 Wheelchair Ramp Installation Task Order Contract Package 1 to Garren Construction, LLC in an amount not to exceed $524,096.22.

 

B.                      An ordinance accepting the lowest responsive bid and awarding the FY 2021 Flatwork and  Street Improvements Task Order Contract Package 1 to San Antonio Concepts Construction, LLC in an amount not to exceed $2,809,877.10 of which $121,300.00 will be reimbursed by San Antonio Water System (SAWS) and $175.00 will be reimbursed by CPS Energy for necessary adjustments to their existing infrastructure.

 

C.                      An ordinance accepting the lowest responsive bid and awarding the FY 2021 Flatwork and Street Improvements Task Order Contract Package 2 to NBM Development, Inc. in an amount not to exceed $1,411,919.10 of which $58,750.00 will be reimbursed by San Antonio Water System (SAWS) and $1,000.00 will be reimbursed by CPS Energy for necessary adjustments to their existing infrastructure.

 

D.                      An ordinance accepting the lowest responsive bid and awarding the FY 2021 Flatwork and Street Improvements Task Order Contract Package 3 to NBM Development, Inc. in an amount not to exceed $1,405,173.50 of which $58,750.00 will be reimbursed by San Antonio Water System (SAWS) and $1,000.00 will be reimbursed by CPS Energy for necessary adjustments to their existing infrastructure.

 

 

BACKGROUND INFORMATION:

 

Project Background

During the FY 2021 Budget process, City Council approved $2.2 million for the NAMP Program and $5 million for the Sidewalk Maintenance Program, a component of the IMP to complete sidewalk and pedestrian-related projects.  The Public Works Department (PWD) regularly solicits Task Order Contracts for construction services and utilizes various contractors to complete the construction of street and sidewalk-related projects.

 

These proposed ordinances authorize the execution of four Task Order Contracts for contract capacity in the total amount of $6,151,065.92 for the construction of the FY 2021 NAMP Program and the FY 2021 IMP Sidewalk Program projects located City wide. The four contracts will provide construction services for flatwork which includes, but is not limited to, the construction of sidewalks, sidewalk repairs, curbs, wheelchair ramps and any other work required for the completion of the assigned projects located throughout the City. 

 

Procurement of Services

 

A.                     The FY 2021 Wheelchair Ramp Installation Task Order Contract Package 1 was advertised   for construction bids on September 2, 2020, in the San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, on TVSA and through the online bidding website CivCast.  Bids for Wheelchair Ramp Installation Task Order Contract Package 1 were due on September 29, 2020, with five (5) bids received.  Garren Construction, LLC was the lowest responsive bidder as indicated in the included bid summary matrix.

 

B.                     The FY 2021 Flatwork and Street Improvements Task Order Contract Package 1 was advertised for construction bids on August 12, 2020, in the San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, on TVSA and through the online bidding website CivCast.  Bids for Flatwork and Street Improvements Task Order Contract Package 1 were due on September 18, 2020, with seven (7) bids received.  San Antonio Concepts Construction, LLC was the lowest responsive bidder as indicated in the included bid summary matrix.

 

C.                     The FY 2021 Flatwork and Street Improvements Task Order Contract Package 2 was advertised for construction bids on August 12, 2020. in the San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, on TVSA and through the online bidding website CivCast.  Bids for Flatwork and Street Improvements Task Order Contract Package 2 were due on September 22, 2020, with ten (10) bids received.  The lowest bidder withdrew their submitted bid due to bid discrepancies.  Therefore, NBM Development, Inc. is the lowest responsive bidder as indicated in the included bid summary matrix.

 

D.                     The FY 2021 Flatwork and Street Improvements Task Order Contract Package 3 was advertised for construction bids on August 12, 2020, in the San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, on TVSA and through the online bidding website CivCast.  Bids for Flatwork and Street Improvements Task Order Contract Package 3 were due on September 25, 2020, with ten (10) bids received.  NBM Development, Inc. was the lowest responsive bidder as indicated in the included bid summary matrix.

 

These contracts are awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program which requires contracts to be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract to maximize the amount of small, minority, and women-owned business participation. Summarized below are the SBEDA goals for each contract. 

 

A.                      The Goal Setting Committee set a 22% Minority/Women Business Enterprise (M/WBE) subcontracting goal for the FY 2021 Wheelchair Ramp Installation Task Order Contract Package 1.  Garren Construction, LLC has committed to meeting these goals.

B.                      The Goal Setting Committee set a 23% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 2% African American Business Enterprise (AABE) subcontracting goal for FY 2021 Flatwork and Street Improvements Task Order Contract Package 1. San Antonio Concepts Construction, LLC has committed to meeting these goals.

These construction contracts were developed utilizing the low bid process; therefore, Contract Disclosure Forms are not required.

 

ISSUE:

C.                     This ordinance accepts the lowest responsive bid and awards the FY 2021 Flatwork and Street Improvements Task Order Contract Package 2 to NBM Development, Inc. in an amount not to exceed $1,411,919.10 of which $58,750.00 will be reimbursed by SAWS and $1,000.00 will be reimbursed by CPS Energy for necessary adjustments to their existing infrastructure.

 

D.                     This ordinance accepts the lowest responsive bid and awards the FY 2021 Flatwork and Street Improvements Task Order Contract Package 3 to NBM Development, Inc. in an amount not to exceed $1,405,173.50 of which $58,750.00 will be reimbursed by SAWS and $1,000.00 will be reimbursed by CPS Energy for necessary adjustments to their existing infrastructure.

 

As part of the Department’s continuing efforts to expedite project delivery and complete infrastructure projects, the task order contracts will allow Public Works to execute multiple projects to be delivered through the NAMP and the IMP Programs.  

 

These sidewalk repair contracts will provide construction services for flatwork which includes, but is not limited to, the construction of sidewalks, sidewalk repairs, curbs, wheelchair ramps, and any other work required for the completion of the assigned projects located throughout the City. 

 

 

ALTERNATIVES:

 

City Council could require the projects to be individually bid for construction; however, construction bid prices could potentially be higher than those estimated with the Task Order Contracts and bidding the projects individually would prolong their delivery.

 

 

FISCAL IMPACT:

 

A.                     This ordinance accepts the lowest responsive bid and awards the FY 2021 Wheelchair Ramp Installation Task Order Contract Package 1 to Garren Construction, LLC in an amount not to exceed $524,096.22. Funds are available and included in the FY 2021 - FY 2026 Capital Improvements Program and may be funded from various funding sources to include, but are not limited to, the General Fund, the Advanced Transportation District Fund, debt proceeds, or other funding sources.

Requirements for each task shall be detailed in the individual task orders assigned.  The City makes no minimum guarantee pertaining to the volume of work.  If funding for any work activities is not previously appropriated, funding will be identified and appropriated through subsequent City Council action.

 

 

RECOMMENDATION:

 

Staff recommends the approval of four construction contracts in the total amount of $6,151,065.92 to complete projects for NAMP and IMP projects located Citywide.  Additional contracts are scheduled to be awarded at a later date for the remaining NAMP and the IMP program projects.
