Real Estate Disposition:  Disposition of a property owned by the San Antonio Water System

 

 

SUMMARY:

 

A resolution declaring a 0.0679-acre tract of land, located along the southern right-of-way of IH-10 east of the intersection of Foster Road in the northeast quadrant of Bexar County, Texas, Council District 2, as surplus and authorizing its disposition by the San Antonio Water System. 

 

BACKGROUND INFORMATION:

 

The Texas Department of Transportation (“TXDOT”) made a request to the San Antonio Water System (SAWS) to purchase a 0.0679-acre tract of land, located along the south right-of-way of IH-10 for its IH-10 Loop 410 Roadway Project.

 

The San Antonio Water System Board of Trustees passed Resolution No. 2020-216 on October 6, 2020 declaring a 0.0679-acre tract of land, located along the southern right-of-way of IH-10 east of the intersection of Foster Road in the northeast quadrant of Bexar County, Texas, as surplus to its system.

 

Under Municipal Code, all city-owned property must be declared as surplus prior to the disposition (sale) of the property.  The request to declare property as surplus must be submitted to Public Works, Real Estate Division, then the request and exhibits are sent to departments and municipal-owned utilities that provide services to, or construct infrastructure on the properties.  City departments and municipal-owned utilities respond if there is a need for the property or if the property may be disposed. 

 

There was no opposition of this request by SAWS to declare as surplus and dispose of a 0.0679-acre tract of land, located along the southern right-of-way of IH-10 east of the intersection of Foster Road in the northeast quadrant of Bexar County, Texas.  With City Council approval, SAWS is authorized to dispose of the property pursuant to the Texas Local Government Code and applicable City of San Antonio policies and procedures.

 

 

 ISSUE:

ALTERNATIVES:

 

Planning Commission could choose not to approve this request; however, this would prevent SAWS from disposing of a property which is no longer necessary for the operation of the San Antonio Water System and the Texas Department of Transportation has the power of eminent domain to acquire this property for its project.

 

 

RECOMMENDATION:

 

Staff recommends approval of this request to declare a  0.0679-acre tract of land, located along the southern right-of-way of IH-10 east of the intersection of Foster Road in the northeast quadrant of Bexar County, Texas, as surplus and authorize its disposition by the San Antonio Water System.
