Real Estate Disposition:  Disposition of a property owned by the San Antonio Water System

 

 

SUMMARY:

 

A Resolution recommending declaring an approximately 123.133-acre tract of land in County Block 4006 located southeast of Mitchell Lake in Council District 3 as surplus and authorizing its disposition by the San Antonio Water System. 

 

 

BACKGROUND INFORMATION:

 

The San Antonio Water System Board of Trustees passed Resolution No. 2020-135 on June 9, 2020 declaring an approximate 123.133-acre tract of land in County Block 4006 near Mitchell Lake as surplus to its system.

 

Under Municipal Code, all city-owned property must be declared as surplus prior to the disposition (sale) of the property.  The request to declare property as surplus must be submitted to Public Works, Real Estate Division, then the request and exhibits are sent to departments and municipal-owned utilities that provide services to, or construct infrastructure on the properties.  City departments and municipal-owned utilities respond if there is a need for the property or if the property may be disposed. 

 

There was no opposition of this request by SAWS to dispose of an approximate 123.133-acre unimproved portion of County Block 4006 located southeast of Mitchell Lake.  With City Council approval, SAWS is authorized to dispose of the property pursuant to the Texas Local Government Code and applicable City of San Antonio policies and procedures.

 

 

 ISSUE:

 

This resolution recommends declaring an approximately 123.133-acre tract of land in County Block 4006 located southeast of Mitchell Lake in Council District 3 as surplus and authorizes its disposition by the San Antonio Water System.

 

The San Antonio Water System Board of Trustees passed Resolution No. 2020-135 on June 9, 2020 declaring an approximate 123.133-acre tract of land in County Block 4006 near Mitchell Lake as surplus to its system.

There was no opposition of this request by SAWS to dispose of an approximate 123.133-acre unimproved portion of County Block 4006 located southeast of Mitchell Lake.  With City Council approval, SAWS is authorized to dispose of the property in accordance with the Chapters 253 and 272 of the Local Government Code.

 

 

ALTERNATIVES:

 

Planning Commission could choose not to recommend approval of this request; however, this would prevent SAWS from disposing of a property which is no longer necessary for the operation of the San Antonio Water System and would require SAWS continue the maintenance of the property.

 

 

RECOMMENDATION:

 

Staff recommends approval of this request to declare an approximately 123.133-acre tract of land in County Block 4006 located southeast of Mitchell Lake in Council District 3 as surplus and authorizes its disposition by the San Antonio Water System.
