Change Order: Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) Project (2017 Bond Project)
SUMMARY:
An ordinance approving a City requested change order in the total increased amount of $583,146.80 and authorizing payment to Pesado Construction Company for construction of adjacent sidewalk projects related to Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project, a 2017 Bond funded project, located in Council District 4. Funds are available from 2017 - 2022 General Obligation Bond Program and are included in FY 2021 - FY 2026 Capital Improvement Program.
BACKGROUND INFORMATION:
Project Background
On May 6, 2017, voters approved the 2017 Bond Program, which authorized $9,170,000.00 for drainage and flood control improvements associated with the Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project located in Council District 4. The Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project will construct an underground storm drain system along Cedarhurst Drive and improvements to the existing drainage outfall allowing flood relief to neighborhood streets. This project will also provide for the full-depth pavement reconstruction of Cedarhurst Drive to include curbs, sidewalks, driveway approaches and utility improvements. Project construction began in January 2020 and is estimated to be completed by April 2021.
As part of the original bid advertisement, the additive alternate for the construction of sidewalks along four adjacent streets was not awarded with the original contract since pricing exceeded the approved District 4 Pedestrian Mobility & Streets project budget for these sidewalks. As a result of favorable base bid pricing and the near completion with minimal issues of the Cedarhurst Drive Area bond project, funds are now available within 2017 Bond Cedarhurst Drive Area project to complete these sidewalks. The cost and time effective option would be to construct these sidewalks along the four adjacent streets to Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) 2017 Bond project.
Previous Council Action
A previously executed contract with Pesado Construction Company for $5,150,164.35 for the construction of 2017 Bond Cedarhurst Drive Area project was approved by City Council on October 31, 2019 through Ordinance 2019-10-31-0875. This will be the first change order for this contract. This proposed change order will increase the contract capacity by $583,146.80 to a revised contract amount of $5,733,311.15.

This change order will compensate the contractor for the work related to the construction of adjacent sidewalk projects along the following four streets:
• Cedarhurst Drive (Farrel Drive to Dumont Drive
• Chadwick Drive
• Baywell Drive
• Ashford Drive
ISSUE:
This ordinance approves a City requested change order in the total increased amount of $583,146.80 and authorizes payment to Pesado Construction Company for construction related work of adjacent sidewalk projects related to Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project, a 2017 Bond funded project, located in Council District 4.

Upon approval of this change order, the construction of this work is anticipated to begin February 2021 and is estimated to be completed April 2021.
ALTERNATIVES:
As an alternative, City Council could require staff to complete the adjacent sidewalk projects through an on-call contractor or bid out this work; however, this would significantly delay the timely completion of these projects. The most cost and time effective option is to approve this change order.
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $583,146.80 payable to Pesado Construction Company for construction of adjacent sidewalk projects related to Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project. Funds are available from 2017 - 2022 General Obligation Bond Program and are included in FY 2021 - FY 2026 Capital Improvement Program.
RECOMMENDATION:
Staff recommends approval of a City requested change order in the total increased amount of $583,146.80 for construction of adjacent sidewalk projects associated with the Cedarhurst Drive Area (Dumont Drive to Eaglerock Drive) project.
