SUBJECT:

 

Amendment & Contract Award:  South Zarzamora Street/Applewhite Road Intersection (2017 Bond Project)

 

 

SUMMARY:

 

Consideration of the following items related to the South Zarzamora Street/Applewhite Road Intersection project:

 

A.                      An ordinance approving the execution of an amendment in the increased amount of $151,580.00 to the $202,000.00 Design Services Agreement between the City and GGE Consulting Engineers, Inc. dba GE Reaves Engineering for additional services associated with the design.  This amendment will also authorize upcoming bid, construction phase and other related services required in relation to the South Zarzamora Street/Applewhite Road Intersection project located in Council District 4.  Funds are available from the 2012 and 2017 General Obligation Bond funds and are included in the FY 2021 - FY 2026 Capital Improvement Program. 

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract to E-Z Bel Construction, LLC in the amount of $1,940,478.83 for the South Zarzamora Street/Applewhite Road Intersection project located in Council District 4.  Funds are available from the 2012 and 2017 General Obligation Bond funds and are included in the FY 2021 - FY 2026 Capital Improvement Program.

 

 

BACKGROUND INFORMATION:

 

Project Background

On May 6, 2017, voters approved the 2017 Bond Program which authorized $900,000.00 for the South Zarzamora Street/Applewhite Road Intersection project located in Council District 4.  As part of the FY 2020 adopted budget, funds in the additional amount of $1,750,000.00 were approved for this project.  The project will provide for demolition and reconstruction of the existing intersection to reconfigure the South Zarzamora Street and Applewhite Road intersection.  Construction is anticipated to begin in March 2021 and is estimated to be completed by January 2022.

 

Amendment

On October 5, 2017, City Council approved a Civil Engineering Design Services Agreement with GE Reaves Engineering Inc. in an amount not to exceed $202,000.00 for the design and construction phase services of the South Zarzamora Street/Applewhite Road Intersection project through Ordinance 2017-10-05-0742.  The proposed amendment will increase the contract by $151,580.00 to a total contract amount of $353,580.00.

This amendment will authorize the additional design services requested and rendered to compensate GGE Consulting Engineers, Inc. dba GE Reaves Engineering for upcoming bid, construction phase, and closeout phase services for the requested project changes. 

 

Procurement of Services

This project was advertised on August 12, 2020, for construction bids in the following media: San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, TVSA, and through the electronic bidding site CivCast.  Bids were opened on September 15, 2020, and three bids were received.  The low bidder was deemed to be not responsible.  E-Z Bel Construction, LLC submitted the lowest responsive bid as indicated in the included matrix. 

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 15% Minority/Women Business Enterprise (M/WBE) and a 3% African-American Owned Business Enterprise (AABE) subcontracting goal.  E-Z Bel Construction, LLC, has agreed to meet the subcontracting participation goals.

 

This construction contract was developed utilizing the low bid process.  Therefore, a Contracts Disclosure Form is not required.

 

 

ISSUE:

 

A.                     This ordinance approves the execution of an amendment in the increased amount of $151,580.00 to the $202,000.00 Design Services Agreement between the City and GGE Consulting Engineers, Inc. dba GE Reaves Engineering for additional services associated with the design, bid, construction phase and other related services required in relation to the 2017 Bond Program South Zarzamora Street/Applewhite Road Intersection project located in Council District 4.

 

During the design of the project, it was determined the street realignment of the intersection was needed to improve traffic flow and functionality of the South Zarzamora Street and Applewhite Road intersection.  With this, as part of the FY 2020 adopted budget funds in the additional amount of $1,750,000.00 were approved for the street realignment of the South Zarzamora Street and Applewhite Road intersection.  At the City’s direction, design changes were requested to include right-of-way, street reconstruction, storm drain improvements, traffic signal removal, and traffic control upgrades.

 

This amendment will authorize the additional design services requested and rendered to compensate GGE Consulting Engineers, Inc. dba GE Reaves Engineering for upcoming bid, construction phase, and closeout phase services for the requested project changes. 

 

B.                     This ordinance accepts the lowest responsive bid and awards a construction contract to E-Z Bel Construction, LLC in the amount of $1,940,478.83 for the 2017 Bond Program South Zarzamora Street/Applewhite Road Intersection project located in Council District 4. 

 

This project will consist of the demolition and reconstruction of the existing intersection to reconfigure South Zarzamora Street and Applewhite Road intersection by removing the traffic signal and creating two T-intersections. Construction is anticipated to begin in March 2021 and is estimated to be completed by January 2022.

 

 

ALTERNATIVES:

 

A.                     As an alternative, City Council could not approve the amendment; however, this would result in the staff’s inability to complete the additional design work necessary to complete the project.

 

B.                     As an alternative, City Council could require staff to re-advertise this project; however, considering the additional time required for another solicitation process would adversely affect the timely completion of the project.

 

 

FISCAL IMPACT:

 

A.                     This is a one-time capital improvement expenditure in the increased amount of $151,580.00 authorized payable to GGE Consulting Engineers, Inc. dba GE Reaves Engineering for the South Zarzamora Street/Applewhite Road Intersection project.  Funds are available from the 2012 and 2017 General Obligation Bond funds and are included in the FY 2021 - FY 2026 Capital Improvements Program.

 

B.                     This is a one-time capital improvement expenditure in the amount of $1,940,478.83 to E-Z Bel Construction, LLC.  Funds are available from the 2012 and 2017 General Obligation Bond funds and are included in the FY 2021 - FY 2026 Capital Improvement Program. 

 

 

RECOMMENDATION:

 

A.                     Staff recommends approval of this ordinance amending the Design Services Agreement between the City and GGE Consulting Engineers, Inc. dba GE Reaves Engineering in the increased amount of $151,580.00 for additional design services for the South Zarzamora Street/Applewhite Road Intersection project.

 

B.                     Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract to E-Z Bel Construction, LLC in the amount of $1,940,478.83 for the South Zarzamora Street/Applewhite Road Intersection project.
