Extension of Line of Duty Leave
SUMMARY:
This Ordinance would extend the line-of-duty (LOD) leave for Fire Captain Edward Guerra Jr. This action will restore one hundred ninety-two (192) hours, or eight (8) shifts of accrued leave. Captain Guerra used leave from January 16, 2014 to February 9, 2014 for an on the job injury which occurred on January 11, 2013.
BACKGROUND INFORMATION:
The Local Government Code, Chapter 143.073, states that after the one-year initial period of leave, the municipality's governing body may extend the line of duty illness or injury leave at full or reduced pay.
Fire Captain Guerra injured his right knee and lower back while lifting a large patient from the floor while assisting on a medical call on January 11, 2013. He was diagnosed with right knee strain, as well as, lumbar sprain/strain. He was given multiple rounds of lumbar injections. Fire Captain Guerra underwent extensive physical therapy, work conditioning and work hardening program before returning to work full duty. He was on Line of Duty leave from January 16, 2013 until January 15, 2014. He began using his own leave on January 16, 2014 to February 9, 2014. Fire Captain Edward Guerra Jr. returned to duty on February 10, 2014.
This ordinance will restore one hundred ninety-two (192) hours, or eight (8) shifts of accrued leave to Captain Guerra. Approval of this ordinance is only within the authority of City Council.
ISSUE:
This ordinance authorizes an extension of Line of Duty leave for Fire Captain Edward Guerra Jr. from January 16, 2014 to February 9, 2014, for an on the job injury suffered on January 11, 2013.
