Contract Award: 2021 - 2022 Task Order Contract for Flatwork and Repair (Package 3)

 

 

SUMMARY:

 

An ordinance accepting the lowest responsive bid and awarding the 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 to DPR Mcham, LLC in an amount not to exceed $1,573,680.50 of which $47,080.00 will be reimbursed by San Antonio Water System (SAWS) for necessary adjustments to their existing infrastructure related to construction services for flatwork and street improvement projects identified in the Neighborhood Access and Mobility Program (NAMP) and Infrastructure Management Program (IMP).

 

 

BACKGROUND INFORMATION:

 

Project Background

With the adoption of the FY 2021 Budget on September 17, 2020, City Council approved $2.2 million for the Neighborhood Access and Mobility Program (NAMP) and $5 million for the Sidewalk Maintenance Program, a component of the Infrastructure Management Program (IMP) to complete sidewalk and pedestrian-related projects. The Public Works Department regularly solicits task order contracts for construction services and utilizes various contractors to complete the construction of street and sidewalk-related projects.  As part of this effort, these programs require the construction or the reconstruction of Americans with Disabilities Act (ADA) compliant ramps which may require an upgrade or installation if major improvements are done to existing pavement.

 

This contract will provide construction services for flatwork which includes, but is not limited to, the construction of new sidewalks, reconstruction of existing deteriorated sidewalks, curbs, wheelchair ramps and any other work required to complete assigned projects located throughout the City.

 

Procurement of Services

The 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 was advertised for construction bids on October 28, 2020 in the San Antonio Hart Beat, the City’s website, the Texas Electronic State Business Daily, on TVSA and through the electronic bidding site CivCast.  Bids for the FY 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 were due on December 1, 2020 with seven (7) bids received.  Of these, the lowest responsive bidder withdrew their bid.  As a result, DPR Mcham, LLC the lowest responsive bidder as indicated in the included bid summary matrix.

 

The contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 20% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 2% African American Business Enterprise (AABE) subcontracting goal.  DPR Mcham, LLC has committed to meeting these goals.

 

This construction contract was developed utilizing the low bid process; therefore, Discretionary Contract Disclosure Forms are not required.

 

 

ISSUE:

 

This ordinance accepts the lowest responsive bid and awards the 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 to DPR Mcham, LLC in an amount not to exceed $1,573,680.50 of which $47,080.00 will be reimbursed by SAWS for necessary adjustments to their existing infrastructure related to construction services for flatwork and street improvement projects.

 

As part of the Department’s continuing efforts to expedite project delivery and complete infrastructure projects, task order contracts allow the Public Works Department to handle multiple projects delivered through the Neighborhood Access and Mobility Program (NAMP) and the Infrastructure Management Program (IMP) with reduced management and improved schedule delivery.

 

This contract will provide construction services for flatwork and street improvements including, but not limited to, the construction of sidewalks, sidewalk repairs, curbs, wheelchair ramps and any other work required for the completion of the assigned projects located throughout the City.

 

 

ALTERNATIVES:

 

City Council could require staff to re-bid this package; however, re-bidding would delay the delivery of the Neighborhood Access and Mobility Program (NAMP) and the Infrastructure Management Program (IMP).

 

 

FISCAL IMPACT:

 

This ordinance accepts the lowest responsive bid and awards the 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 to DPR Mcham, LLC in an amount not to exceed $1,573,680.50 of which $47,080.00 will be reimbursed by SAWS.  Funds are available and included in the FY 2021 - FY 2026 Capital Improvement Program and may be funded from various funding sources, including the General Fund, the Advanced Transportation District Fund, debt proceeds or other funding sources.

 

Requirements for each task shall be detailed in the individual task orders assigned.  The City makes no minimum guarantee pertaining to the volume of work.  If funding for any work activities is not previously appropriated, funding will be identified and appropriated through subsequent City Council action.

 

 

RECOMMENDATION:

 

Staff recommends approval of the 2021 - 2022 Task Order Contract for Flatwork and Repair Package 3 to DPR Mcham, LLC in the total amount of $1,573,680.50 to provide construction services for flatwork and street improvement projects.
