Agreements to Contribute Right of Way Funds (Fixed Price) for TxDOT Projects

 

 

SUMMARY:

 

An ordinance approving the execution of four Agreements to Contribute Right of Way Funds (Fixed Price) between the City of San Antonio and the Texas Department of Transportation (TxDOT) and authorizing payment in the amount not to exceed $348,060.00 to TxDOT for the acquisition of right-of-way and the relocation or adjustment of utilities associated with four TxDOT projects.  Funds are available from FY 2021 Certificates of Obligation and are included in the FY 2021 - FY 2026 Capital Improvement Program. 

 

 

BACKGROUND INFORMATION:

 

Project Background

The Texas Administrative Code, Title 43, Part 1, Chapter 15, Subchapter E, Rule 15.52 and 15.55 requires a joint participation agreement and monetary contribution from the local government to TxDOT for certain State highway improvement projects requiring the acquisition of right-of-way and the relocation or adjustment of utilities associated with these projects.  As part of the FY 2021 Adopted Budget, funds in the amount of $359,875.00 were approved for four TxDOT projects requiring right-of-way acquisition. 

 

These four TxDOT projects include the following:

 

                     FM 1560 from FM 471 to Galm/Shaenfield Road

                     PA 1502 from Lockhill Selma Road to NW Military

                     Loop 1604 at FM 2696 (Blanco Road)

                     FM 1516 from FM 78 to IH 10

 

The approval of the four agreements to contribute right-of-way funds is necessary to complete these projects and allows the City to comply with the Texas Administrative Code through cooperation and participation with TxDOT for highway improvement projects within the City limits. 

 

 

ISSUE:

 

This ordinance approves the execution of four Agreements to Contribute Right of Way Funds (Fixed Price) between the City of San Antonio and the Texas Department of Transportation (TxDOT) and authorizes payment in the amount not to exceed $348,060.00 to TxDOT for the acquisition of right-of-way and the relocation or adjustment of utilities associated with four TxDOT projects. 

 

The Texas Administrative Code requires a joint participation agreement and monetary contribution from the local government to TxDOT for certain State highway improvement projects requiring the acquisition of right-of-way and the relocation or adjustment of utilities. 

 

The approval of the four agreements will allow the City to contribute right-of-way funds for the following four TxDOT projects:

 

                     FM 1560 from FM 471 to Galm/Shaenfield Road

                     PA 1502 from Lockhill Selma Road to NW Military

                     Loop 1604 at FM 2696 (Blanco Road)

                     FM 1516 from FM 78 to IH 10

 

The approval of these agreements to contribute right-of-way funds is necessary to complete these projects and the City will be responsible for 10% of the required local participation costs for these projects.

 

Approval of this ordinance will be a continuation of the City’s commitment to maintaining and improving existing infrastructure in collaboration with other governmental agencies.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to approve these agreements; however, the City would therefore not comply with the Texas Administrative Code and this will delay the completion of these projects.

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in the total amount of $348,060.00 payable to TxDOT.  Funds are available from FY 2021 Certificates of Obligation and are included in the FY 2021 - FY 2026 Capital Improvement Program.

 

 

RECOMMENDATION:

 

Staff recommends approval of the of four Agreements to Contribute Right of Way Funds (Fixed Price) between the City of San Antonio and the Texas Department of Transportation (TxDOT) and authorizes payment in the amount not to exceed $348,060.00 to TxDOT for the acquisition of right-of-way and relocation or adjustment of utilities associated with four TxDOT projects.
