Task Order for Dan Markson Park

 

 

SUMMARY:

 

This ordinance authorizes a task order to a Job Order Contract to Jamail & Smith Construction, LP for the construction of Dan Markson Park located in Council District 8 in an amount not to exceed $900,000.00. Funding in the amount of $224,701.56 will come from the 2017 Bond, $605,298.44 from the Parks Development and Expansion - 2015 Venue Projects Fund, and $70,000.00 will be appropriated from the FY 2021 Parks and Recreation Department General Fund Adopted Budget and this action amends the FY 2021 - FY 2026 Capital Improvement Program.

 

 

BACKGROUND INFORMATION:

 

Dan Markson Park located at Babcock and Hausman Road, was deeded to the City in 2018 by the Maverick Creek Homeowners Association.  The Maverick Creek Greenway has been constructed on part of the property and was opened to the public in early 2021.  The Parks and Recreation Department has worked with the community to complete a design for an inclusive playground and park which will be completed in 2022. 

 

Dan Markson Park was designed to be an inclusive park for people of all abilities.  The playground will accommodate mobility assistance devices such as wheelchairs, panels which promote sensory stimulation such as hearing and touch, and shade & gathering areas for all to enjoy.  Park development includes a restroom building with an adult changing station and lighting with a connection to the Maverick Creek Greenway.  Planned exercise stations will complement the greenway trail and seating areas will provide a respite from activity while presenting opportunities to enjoy a butterfly pollinator wildscape.   

 

This is a task order utilizing Job Order Contracting (JOC), an alternative project delivery method in which ten contractors were approved through Ordinance 2019-02-21-0134 by City Council on February 21, 2019.  The use of the JOC delivery method provides the City with on-call construction, renovation and maintenance services for City buildings and facilities.  Assignment of JOC contractors to specific jobs is based on the contractor’s current workload, overall capacity, and familiarity with a specific facility, expertise in completing specific task and/or managing a specific trade needed to carry out the requested repair or rehabilitation.  Of the ten contractors, Jamail & Smith Construction, LP was selected to submit an estimate and project schedule for this Project.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 24% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 4% African American Business Enterprise (AABE) subcontracting goal.  Jamail & Smith Construction, LP has committed to a 24% M/WBE and 4% AABE subcontractor participation. 

 

The Discretionary Contracts Disclosure Form, as required by the City’s Ethics Ordinance for all Projects where subjective criteria are used to select the contractor or consultant rather than low bid, is attached.

 

 

ISSUE:

 

This ordinance authorizes a task order to a Job Order Contract for the Dan Markson Park construction in an amount not to exceed $900,000.00 to Jamail & Smith Construction, LP. Funding in the amount of $224,701.56 will come from the 2017 Bond, $605,298.44 from the Parks Development and Expansion - 2015 Venue Projects Fund, and $70,000.00 will be appropriated from the FY 2021 Parks and Recreation Department General Fund Adopted Budget and this action amends the FY 2021 - FY 2026 Capital Improvement Program.  

 

 

ALTERNATIVES:

 

As an alternative, this project could be delivered utilizing another delivery method which could adversely impact project cost and timeline.

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in an amount not to exceed $900,000.00 authorized payable to Jamail & Smith Construction, LP.  Funding in the amount of $224,701.56 will come from the 2017 Bond, $605,298.44 from the Parks Development and Expansion - 2015 Venue Projects Fund, and $70,000.00 will be appropriated from the FY 2021 Parks and Recreation Department General Fund Adopted Budget and this action amends the FY 2021 - FY 2026 Capital Improvement Program.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance authorizing a task order to a Job Order Contract in an amount not to exceed $900,000.00 to Jamail & Smith Construction, LP for the construction of Dan Markson Park.
