SUBJECT:

 

Contract Award: Callaghan Road - IH 410 to Spur 421 (Bandera Rd)

 

 

SUMMARY:

 

An Ordinance for the Callaghan Road  2012-2017 Bond Program and federally funded Project, awarding a construction contract in the amount of $15,385,582.53 to Harper Brothers Construction, LLC of which $2,000,351.03 will be reimbursed by San Antonio Water System, and $571,217.40 will be reimbursed by CPS Energy located in Council District 7.

 

BACKGROUND INFORMATION:

 

The 2012 General Obligation Bond authorized $6,630,000.00 for the Callaghan Road Project. The Project provides the reconstruction of the roadway, sidewalks, curbs, a shared use path and drainage from IH 410 to Spur 421 (Bandera Road).  The existing roadway has two lanes with curbs. This Project will widen the roadway to four lanes  with a center left turn lane, including sidewalks and a shared use path. Construction is scheduled to begin in January 2016 and estimated to be completed in July 2017.

 

Previous Council Action

On June 13, 2013, City Council approved the Advanced Funding Agreement with the Texas Department of Transportation for the Callaghan Road (Evers Road to Centerview Drive) Project through Ordinance 2013-06-13-0416.  On August 14, 2014, City Council approved an amendment to the Advanced Funding Agreement with the Texas Department of Transportation to extend the Callaghan Road Project limits of the from IH 410 to Spur 421 (Bandera Road).  As a Local Agency Management (LAM) project, the City must follow federal requirements to ensure reimbursement from TxDOT in the amount of $10,360,916.00 related to construction costs for the Callaghan Road - IH 410 to Spur 421 (Bandera Rd) Project.

 

Procurement of Services
The Project was advertised for construction bids in the San Antonio Hart Beat, on the City of San Antonio’s website and the Texas Electronic State Business Daily in July 2015.  In addition, the bid announcement was made on TVSA.  Bids for this Project were opened on August 28, 2015 and five bidders responded. Harper Brothers Construction, LLC submitted the lowest responsive bid. 

 

The Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of SBEDA.

 

This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

ISSUE:

 

This ordinance for the Callaghan Road Project, a Federal Highway Administration and 2012 General Obligation Bond - funded Project, located in Council District 7, accepts the lowest responsive bid and awards a construction contract in the amount of $15,385,582.53, authorized payable to Harper Brothers Construction, LLC, of which $2,000,351.03 will be reimbursed by San Antonio Water Systems (SAWS), and $571,217.40 will be reimbursed by CPS Energy.  

 

This Project provides the reconstruction and widening to a four lane roadway including center left turn lanes, sidewalks, curbs, a shared-use path and drainage along Callaghan Road from IH 410 to Spur 421 (Bandera Rd).  Construction of this Project is scheduled to begin in January 2016 and is estimated to be completed in July 2017. Construction activities will take place six days a week from sunrise to sunset.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.   

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in the amount of $15,385,582.53, payable to Harper Brothers Construction, LLC. Of this amount, $2,000,351.03 will be reimbursed by San Antonio Water Systems (SAWS) and $571,217.40 will be reimbursed by CPS Energy. 

 

On June 13, 2013, Council approved an Advanced Funding Agreement with TxDOT for the Callaghan Road Project through Ordinance 2013-06-13-0416 in the amount of $8,708,128.00. An amendment to the agreement for $1,652,788.00 was approved through Ordinance 2014-08-14-0571. This ordinance approves an additional amendment for $1,113,799.00 which brings the total agreement to $11,474,715.00 in federal funds allocated to the City from TxDOT and administered by TxDOT as a federal pass through grant associated with the construction of the Callaghan Road Project.

 

This ordinance also reallocates $937,263.18 in federal funds from TxDOT from two completed Local Agency Managed projects.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance awarding a construction contract in the amount of $15,385,582.53 to Harper Brothers Construction, LLC for construction of Callaghan Road from IH 410 to Spur 421 (Bandera Rd) of which $2,000,351.03 will be reimbursed by San Antonio Water Systems (SAWS), and $571,217.40 will be reimbursed by CPS Energy.
