Contract Award & Disposition: Quintana Road (Harmon Avenue to McKenna Avenue)

 

 

SUMMARY:

 

Consideration of the following items related to the Quintana Road Project (Harmon Avenue to McKenna Avenue), a federally funded project, located in Council District 5:

 

A.                     An ordinance authorizing the execution of an amendment to the Interlocal Agreement between the City of San Antonio and the Port Authority of San Antonio in the increased amount not to exceed $2,129,661.83 for the acceptance of funds from Port Authority to the City of San Antonio for its share of construction-related expenses for the Quintana Road (Harmon Avenue to McKenna Avenue) project. 

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract including one additive alternate in an amount not to exceed $9,890,322.32 payable to SpawGlass Civil Construction, Inc. in which funds in the amount not to exceed $4,717,766.93 will be reimbursed by the Texas Department of Transportation (TxDOT); an amount not to exceed $3,294,528.37 will be reimbursed by the Port Authority of San Antonio; an amount not to exceed $761,537.30 will be reimbursed by San Antonio Water System (SAWS); and an amount not to exceed $1,116,489.72 will be reimbursed by CPS Energy for construction of Quintana Road (Harmon Avenue to McKenna Avenue). 

 

C.                     An ordinance authorizing to close, vacate and abandon a 0.328 acre (14,266 square foot) improved section of Lester Avenue from the alley north of McKenna to the intersection of Quintana Road for the completion of the Quintana Road (Harmon Avenue to McKenna Avenue) project.

 

 

BACKGROUND INFORMATION:

 

Project Background

The Port Authority of San Antonio initiated a review of the existing configuration of Quintana Road in an effort to improve traffic flow and functionality in the area.  The Quintana Road Project from Harmon Avenue to McKenna Avenue was established and funded through the Alamo Area Metropolitan Planning Organization (MPO) as a Local Area Managed (LAM) project by the Port.  LAM projects are managed by the City, but receive federal funds administered through TxDOT

 

The Quintana Road project will rehabilitate and realign Quintana Road as well as provide flood control improvements from Harmon Avenue to McKenna Avenue facilitating truck traffic to the Port Authority of San Antonio rail yard area.  Once completed, the project will improve traffic flow and functionality of the roadway for businesses and the public.  This project is anticipated to begin in September 2019 and estimated to be completed in March 2021.

 

Previous Council Action 

Upon approval of the Advanced Funding Agreement through Ordinance 2014-06-26-0506 between the City and TxDOT, City Council simultaneously approved the execution of an ILA between the City and the Port Authority of San Antonio under the same ordinance 2014-06-26-0506.  The ordinance authorized reimbursement to the Port Authority for design, environmental and construction administration by its consultant and acceptance of funds from the Port Authority for the Project match portion of project related expenses. The Port Authority of San Antonio oversaw the design of the roadway improvements and the City of San Antonio is managing construction and coordinating with TxDOT on behalf of the Port Authority.

Procurement of Services

This project was advertised for construction bids in the San Antonio Hart Beat, on the City’s website and the Texas Electronic State Business Daily in February 2019.  In addition, the bid announcement was made on TVSA and through the Small Business Economic Development Advocacy (SBEDA) Office.  Plans were available for review by potential bidders at the office of Civil Engineering Consultants, Inc., located at 11550 IH 10 West, Suite 395 San Antonio, Texas 78230.  Bids for this project were opened on March 12, 2019 and three (3) bidders responded.  Of these, SpawGlass Civil Construction, Inc. submitted the lowest responsive bid.  A summary of the bid outcome is included as an attachment.

 

Due to the utilization of federal dollars, the Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of SBEDA.  The DBE goal for this project is 7%.  This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

As part of the Quintana Road project, the City of San Antonio is requesting to close, vacate and abandon a 0.328 acre (14,266 square foot) improved section of Lester Avenue from the alley north of McKenna to the intersection of Quintana Road necessary for the completion of a water detention drainage feature.  The City of San Antonio and the Port Authority of San Antonio are the abutting property owners to the proposed section of Lester Avenue requesting to be closed.

 

The proposed closure was canvassed through city departments and utilities, and was approved per Chapter 37.  Citizens within a 500-foot radius were mailed notification about the road closure on March 22, 2019 with public sign notification placed on March 29.

 

 

ISSUE:

 

Consideration of the following items related to the Quintana Road Project (Harmon Avenue to McKenna Avenue), a federally funded project, located in Council District 5:

 

A.                     An ordinance authorizing the execution of an amendment to the Interlocal Agreement between the City of San Antonio and the Port Authority of San Antonio in the increased amount not to exceed $2,129,661.83 for the acceptance of funds from Port Authority to the City of San Antonio for its share of construction-related expenses for the Quintana Road (Harmon Avenue to McKenna Avenue) project. 

 

Based on the high bid prices received for construction of Quintana Road (Harmon Avenue to McKenna Avenue), funds are needed to ensure construction of this project is fully funded.  This amendment will authorize the acceptance of funds in the additional amount of $2,129,661.83 from the Port Authority of San Antonio for the construction of Quintana Road (Harmon Avenue to McKenna Avenue) project. 

 

B.                     This ordinance accepts the lowest responsive bid and awards a construction contract including one additive alternate in an amount not to exceed $9,890,322.32 payable to SpawGlass Civil Construction, Inc. in which funds in the amount not to exceed $4,717,766.93 will be reimbursed by the Texas Department of Transportation (TxDOT); an amount not to exceed $3,294,528.37 will be reimbursed by the Port Authority of San Antonio; an amount not to exceed $761,537.30 will be reimbursed by San Antonio Water System (SAWS); and, an amount not to exceed $1,116,489.72 will be reimbursed by CPS Energy for construction of the Quintana Road (Harmon Avenue to McKenna Avenue) project.

C.                     This ordinance authorizes to close, vacate and abandon a 0.328 acre (14,266 square foot) improved section of Lester Avenue from the alley north of McKenna to the intersection of Quintana Road for construction of the Quintana Road (Harmon Avenue to McKenna Avenue) project.

ALTERNATIVES:

 

A.                     As an alternative, City Council could choose not to approve this amendment; however, without the acceptance of the additional funding from the Port Authority the construction of the project will not be fully funded and the proposed improvements for the Quintana Road Project will not be constructed.

 

B.                     As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project; however, re-advertising the project does not guarantee a lower bid and considering the additional time required for another solicitation process would adversely affect the timely completion of the project.

 

C.                     As an alternative, City Council could choose not to approve the road closure request; however, if not approved, the proposed improvements for the Quintana Road Project cannot be constructed.

 

 

FISCAL IMPACT:

 

A.                     This ordinance authorizes acceptance of additional funds in the amount not to exceed $2,129,661.83 from The Port Authority of San Antonio for construction related expenses, to include join bid utilities for a total revised amount not to exceed $4,452,379.83.  The FY 2019-2024 Capital Improvement Budget will be amended to reflect additional funds in the amount not to exceed $2,129,661.83 to supplement funds administrated by TxDOT as a federal pass through grant associated with construction of Quintana Road (Harmon Avenue to McKenna Avenue) Project.

B.                     This is one-time capital improvement expenditure in the amount not to exceed $9,890,322.32 payable to SpawGlass Civil Construction, Inc. in which funds in the amount not to exceed $4,717,766.93 will be reimbursed by the Texas Department of Transportation (TxDOT); an amount not to exceed $3,294,528.37 will be reimbursed by the Port Authority of San Antonio; an amount not to exceed $761,537.30 will be reimbursed by San Antonio Water System (SAWS); and, funds in the amount not to exceed $1,116,489.72 will be reimbursed by CPS Energy for the construction of the project. 

 

C.                     The Quintana Road Project is a Local Agency Managed (LAM) project funded by the Federal Highway Administration and the State of Texas Economically Disadvantaged County Program, both administered through the Texas Department of Transportation with the Project match provided by the Port Authority of San Antonio.

 

The proposed closure of Lester Avenue is valued at $18,000.00, in which the City will retain 100% of the interest.  The City of San Antonio will be responsible for the structural function of the detention pond and the Port Authority of San Antonio will maintain the required mowing.

 

 

RECOMMENDATION:

 

Staff recommends approval of the following items related to Quintana Road (Harmon Avenue to McKenna Avenue), a federally funded project, located in Council District 5:

 

A.                     Staff recommends approval of the execution of an amendment to the Interlocal Agreement between the City of San Antonio and the Port Authority of San Antonio in the increased amount not to exceed $2,129,661.83 for the acceptance of funds from Port Authority to the City of San Antonio for its share of construction-related expenses for the Quintana Road (Harmon Avenue to McKenna Avenue) project. 

 

B.                     Staff recommends awarding a construction contract, including one additive alternate in the amount not to exceed $9,890,322.32 payable to SpawGlass Civil Construction, Inc. for construction of the Quintana Road (Harmon Avenue to McKenna Avenue) project.

 

C.                     Staff recommends approval to close, vacate and abandon an improved section of Lester Avenue from the alley north of McKenna to the intersection of Quintana Road needed for the construction of the Quintana Road (Harmon Avenue to McKenna Avenue) project.
